Een woningcorporatie vormt een fiscale voorziening voor toekomstig onderhoud aan haar woningcomplexen. De inspecteur stelt dat dit alleen mag als de onderhoudsuitgaven in een jaar substantieel hoger zijn dan gemiddeld: het zogenoemde piekvereiste.
